How Long Do Families Have to File a Wrongful Death Claim in Chicago, IL?
After a fatal pedestrian accident in Chicago, families generally have two years from the date of death to file a wrongful death claim in Illinois. This deadline can affect whether the case can move forward.
When a pedestrian dies after being struck by a vehicle, a wrongful death claim may help surviving family members address funeral expenses, final medical bills, and lost financial support. The claim may also account for how the death affects close family members.
Before a family files a claim, it helps to understand who can bring the case under Illinois law. In many cases, a personal representative files the claim for the benefit of surviving family members. The facts of the case can affect how that process works.
Because time can weaken a claim, families should avoid waiting until the deadline is close. Records may become harder to collect as months pass. Witnesses may also forget details that could help explain what happened.
In some cases, exceptions may affect the filing deadline. For example, different rules may apply if the claim involves a government agency, a minor beneficiary, or facts that were not clear right away. These issues can change how much time a family has to act.
If an insurance company contacts the family, it may ask for statements, records, or signed forms. The insurer may also question damages, coverage, or fault. Families should speak with a Chicago wrongful death lawyer before agreeing to a settlement.
An attorney can review the documents, explain what they mean, and help the family avoid missed deadlines.
