Who Can File a Wrongful Death Claim After a Fatal Car Crash in Illinois?
After a fatal car crash in Illinois, a wrongful death claim is usually filed by the personal representative of the victim’s estate. This person may be named in the will or appointed by the court. The claim is brought on behalf of surviving relatives who suffered financial or emotional losses because of the death.
If a personal representative was not named, the court can appoint one, often a close family member such as a spouse, adult child, or parent. This representative manages the case and ensures that any recovery is distributed to those legally entitled to receive it.
Family members who can receive compensation include the spouse, children, or next of kin. Illinois law recognizes these relatives as the people most affected by the loss. The goal of a wrongful death claim is to address the financial and personal impact caused by the fatal crash.
Compensation may include medical expenses from the final injury, funeral and burial costs, and lost income or support. Families may also recover for loss of companionship, guidance, or emotional support. Each claim depends on the family’s relationship with the victim and the extent of their loss.
To file a claim, the representative must gather important records such as medical reports, police documents, and proof of expenses. These materials show how the death affected surviving relatives and help support the claim.
A wrongful death lawyer can guide families through this process. A lawyer can explain filing requirements, collect evidence, and communicate with insurance companies. They can also help estimate the potential value of the case based on its unique details.
Under Illinois law, families generally have two years from the date of death to file a wrongful death claim. Acting quickly helps preserve evidence and ensures the case meets all legal deadlines.
