How Wrongful Death Claims Work in Schaumburg, IL

When a crash takes someone’s life, Illinois law allows the family to seek compensation through a wrongful death claim. A representative of the estate usually files the case. The claim may cover funeral costs, lost income, and loss of companionship.

Around Schaumburg, busy roads like Roselle Road, Higgins Road, and Schaumburg Road carry steady traffic. Motorcyclists face serious danger at intersections where turning drivers may not see them in time. Afternoon congestion can make that risk worse.

After a fatal motorcycle crash, your family usually has two years under Illinois law to file a wrongful death claim. Missing that deadline can end the right to seek compensation. Starting early helps protect records, evidence, and witness details.

Because motorcycle riders have little protection, intersection crashes often cause devastating injuries. One impact can lead to head trauma, spinal injuries, internal injuries, or death. Even with helmets, a collision can still be fatal.

Even if fault is disputed, Illinois law may still allow your family to recover compensation. The final amount depends on each party’s share of responsibility. Families may seek damages for funeral expenses, lost support, and the emotional loss caused by the death.

When your family is grieving, the legal process can feel overwhelming. A wrongful death lawyer can investigate the crash, collect evidence, speak with insurers, and build the claim. Early legal help can also protect evidence that may disappear quickly.
