What Should Families Do After a Fatal Motorcycle Crash in Pekin, IL?
Families should start by requesting a copy of the police report, preserving any available photos or witness contact information, and avoiding early settlement offers from insurance companies before the full extent of damages is understood.
Families have to gather medical and autopsy records, funeral expenses, and documentation of the motorcyclist’s lost income to support a claim. Illinois’s Wrongful Death Act allows a spouse, children, or other next of kin to pursue compensation for these losses, while a separate survival action can address pain and suffering the motorcyclist experienced between the crash and their death.
Because Illinois has no helmet requirement, insurance adjusters sometimes raise the rider’s choice not to wear one as a way to reduce a payout, even though it isn’t required by law. A wrongful death lawyer can help push back on that argument and can also handle requests for traffic camera footage before it’s lost. Illinois follows a modified comparative negligence standard, which means a family’s recovery is reduced only if the motorcyclist is found more than 50 percent at fault.
