What Compensation Is Available After A Pedestrian Accident in Illinois?

After a pedestrian crash in Illinois, victims may be eligible for various forms of compensation. In Illinois, victims can seek compensation for medical bills, lost wages, pain and suffering, and other damages related to the crash.

First, compensation for medical expenses is one of the most common types of recovery. This includes coverage for hospital bills, doctor visits, surgeries, and any ongoing treatments such as physical therapy.

In Illinois, personal injury protection (PIP) benefits may be available under your own car insurance policy, especially if the driver who hit you was uninsured or underinsured. If the driver at fault has insurance, their liability coverage can also help cover medical costs.

Victims may also be entitled to compensation for lost wages, which covers any income lost due to injuries that prevent them from working. In some cases, if the injuries are severe, this compensation may also account for future lost earning capacity, especially if the victim is unable to return to work or must change careers due to long-term disabilities.

In addition to medical costs and lost wages, pain and suffering is another key form of compensation that victims can seek. This type of compensation aims to address the physical and emotional toll that an accident can have.

The amount of compensation for pain and suffering varies depending on the severity of the injuries and how they impact the victim’s life, including their ability to perform everyday activities.

Lastly, in some cases, punitive damages may be available if the at-fault driver’s behavior was especially reckless or malicious. These damages are intended to punish the driver and deter similar conduct in the future.

A pedestrian accident lawyer can help explain what types of compensation may be available based on the facts of the crash. This can include reviewing insurance information, organizing medical paperwork, and helping with communication involving the claim. Legal guidance can be useful when injuries are serious or when questions come up about coverage, documentation, or timelines.
