What Compensation May Be Available After a Fatal Pedestrian Crash in Chicago, IL?

When a person is killed in a pedestrian crash in Chicago, surviving family members may have the right to pursue a wrongful death claim. Under Illinois law, certain relatives may be eligible to seek compensation for funeral expenses, lost financial support, and the loss of companionship. This includes spouses, children, and parents.

Fatal crashes frequently leave families facing difficult questions about financial stability, grief, and legal rights all at once. A Chicago wrongful death attorney can help surviving family members understand what documentation may be needed, how liability is determined, and whether any parties may bear responsibility for the loss.

In Illinois, wrongful death claims are subject to a two-year statute of limitations, which means surviving family members generally have two years from the date of death to file a lawsuit. Missing that deadline can eliminate the right to seek compensation entirely, regardless of how strong the case may be. Consulting an attorney as early as possible helps ensure that evidence is preserved and that no critical deadlines are missed.
