Who Can File a Wrongful Death Claim After a Fatal Crash in Warren Co., Illinois?

In Illinois, the right to file a wrongful death claim is limited to specific family members. The deceased person’s spouse, children, and next of kin are generally the parties eligible to bring a claim. The action is filed by the personal representative of the estate on behalf of those surviving family members. Illinois law sets a two-year statute of limitations on wrongful death claims, that in other words means that the filing window begins on the date of death.

When a fatal crash involves a commercial truck, the potential pool of liable parties can be broader than in a standard two-car collision. Beyond the truck driver, liability can extend to the trucking company, the owner of the tanker trailer, or the company responsible for loading the cargo.

Rural intersections throughout Illinois frequently see heavy commercial traffic. It frequently requires a thorough review of driver logs, vehicle maintenance records, and cargo documentation to determine fault in these crashes.

Wrongful death claims in Illinois can recover compensation for funeral and burial costs, lost income the deceased would have provided, and the loss of companionship and guidance that surviving family members now face. These claims are separate from any criminal investigation and can move forward regardless of whether charges are filed against the other driver.

After a fatal accident, a wrongful death attorney can help surviving family members understand whether a wrongful death claim is available and what evidence may be needed to support it. Legal guidance can also clarify how Illinois law applies to the specific circumstances of the crash.
