Who Can File a Wrongful Death Claim in Chicago, IL?

The personal representative of the deceased person’s estate can file a wrongful death claim in Chicago on behalf of the surviving spouse and next of kin. A will may name the representative, or a probate court may appoint one. The representative then manages the claim for the eligible family members.

In many cases, a surviving spouse, adult child, or another close relative serves in that role. However, serving as the representative does not mean that person receives the entire recovery. Illinois law considers each eligible relative’s relationship to the deceased and the losses connected to the death.

Across Chicago, fatal traffic crashes can raise estate and wrongful death questions at the same time. Busy South Side roads, including Western Avenue, Ashland Avenue, and 63rd Street, carry steady traffic through nearby neighborhoods. Still, Illinois law requires the estate’s appointed representative to bring the claim.

When no will names an executor, a court may appoint an administrator to manage the estate. That appointment gives the person authority to file the claim and handle related documents. However, it does not automatically determine how any recovery will be divided among surviving relatives.

Beyond naming a representative, filing deadlines and available evidence can also shape how the case moves forward. Witness statements, video, vehicle records, and other documents may help establish fault and show the family’s losses. Shorter deadlines may also apply when a public body is involved.

With several issues to address, the process can become difficult to manage. A Chicago wrongful death lawyer can review the details, preserve evidence, and explain the filing process. An attorney can also help the representative understand which options may be available.
