Time Limits for Filing a Wrongful Death Claim in Illinois

In Illinois, wrongful death claims usually must be filed within a set legal timeframe. Most cases follow a two-year period from the date a person passes away. This standard rule applies in many situations and sets the foundation for filing deadlines.

The timeline often begins when the death occurs rather than when the injury happened. This distinction matters because delays between injury and death can affect when the filing period starts. Clear records help confirm the correct starting point.

Some situations may change how the deadline applies. For example, delays in identifying the cause of death can affect when a claim becomes valid. These circumstances depend on the specific facts surrounding the case.

Cases involving minors or individuals who cannot act legally may follow different timing rules. Courts may allow adjustments to ensure fair access to the legal process. These changes focus on who is eligible to bring the claim.

Claims involving government entities often require faster action and additional notice steps. Filing requirements may differ from standard cases and include strict procedural rules. Missing these steps can affect whether a claim moves forward.

Failing to file within the allowed time can lead to dismissal of the case. Courts may refuse to hear claims submitted after the deadline passes. This can limit any legal options that may have been available.
