Can Passengers Seek Compensation After a Crash in Illinois?
Yes, passengers injured in a car crash in Illinois can seek compensation for their injuries. In most cases, passengers are considered blameless parties in an accident, which puts them in a strong position when pursuing a claim. Depending on the circumstances, a passenger may file a claim against the at-fault driver’s insurance, the driver of their own vehicle, or both.
Illinois follows a fault-based system, meaning the party responsible for causing the crash bears financial liability for resulting injuries. When a single driver’s negligence caused the accident, an injured passenger typically files a claim against that driver’s bodily injury liability insurance. If multiple drivers contributed to the crash, a passenger may have grounds to pursue claims against more than one party.
Passengers sometimes hesitate to file a claim when the at-fault driver is a friend or family member. However, in most situations a claim goes through the driver’s insurance policy rather than coming directly from that person. Illinois law does not bar passengers from seeking compensation simply because of their relationship to the driver involved.
Compensation available to injured passengers in Illinois can include medical expenses, lost wages, pain and suffering, and costs related to ongoing rehabilitation or long-term care. Illinois operates under a modified comparative negligence rule, meaning a passenger can still recover compensation as long as they are not more than 50 percent at fault. In the vast majority of passenger injury cases, fault does not attach to the passenger at all.
Insurance companies often move quickly after serious crashes to gather information and assess liability. Passengers who speak with insurance adjusters without legal guidance may unintentionally say something that affects their claim. Having a car accident attorney involved early helps ensure that all communications are handled carefully and that no options are closed off prematurely.
