Legal Options For Families After a Fatal Car Accident in Chicago

Families may have the option to pursue a wrongful death claim when a loved one dies in a car accident in Chicago. Under Illinois law, certain surviving relatives can seek compensation for financial losses and other related damages.

Fatal crashes on high-speed roadways often leave families facing sudden expenses. Costs may include medical treatment provided before death, funeral arrangements, and the loss of financial support. In some cases, families may also seek compensation for loss of companionship or guidance, depending on the circumstances and applicable law.

In Illinois, families generally have two years from the date of death to file a wrongful death lawsuit. This time limit is known as the statute of limitations. Filing after the deadline can result in the court dismissing the claim, although limited exceptions may apply in certain situations.

A Chicago wrongful death lawyer can help gather medical records, crash reports, and other documentation connected to the collision. Legal guidance may also assist with communication between families and insurance companies. Because wrongful death claims follow specific timelines and legal standards, understanding the process early can help families make informed decisions.
