How Long Families Have to File a Wrongful Death Lawsuit After a Crash in Illinois
Families in Illinois generally have two years from the date of a person’s death to file a wrongful death lawsuit after a fatal crash. This deadline comes from the Illinois Wrongful Death Act and is known as the statute of limitations. If a claim is filed after that period, the court may not allow the case to proceed. Because timelines can depend on specific circumstances, reviewing the situation early can help clarify what legal options may still be available.
Fatal vehicle accidents often leave families with many practical questions. A wrongful death claim allows a representative of the deceased person’s estate to bring a case on behalf of surviving relatives. Courts may review factors such as medical costs related to the injury, funeral expenses, and the financial support the person previously provided to family members.
Multi-vehicle crashes sometimes involve complicated documentation and insurance questions. Reports from emergency responders, medical records, and witness accounts may all play a role in understanding how a collision occurred. Keeping these records organized can help families review what information is available if they later decide to explore legal options.
