Compensation Available After a Fatal Crash in Illinois
Illinois law allows families to recover compensation for funeral and burial expenses after a fatal crash. This can also cover costs for the deceased’s final arrangements, including transportation and memorial services.
If the person received emergency treatment, surgery, or ambulance transport before passing, those bills may be recoverable. Medical costs incurred between the crash and death are a separate category of loss. Families can pursue reimbursement through a claim.
Illinois law recognizes the financial contributions a person would have provided over their lifetime. Lost wages, benefits, and future earning capacity can all factor into a claim. The household’s financial position after the loss is central to calculating this type of damage.
Surviving spouses and children experience the absence of a person’s presence, support, and relationship in daily life. Illinois wrongful death law accounts for this loss separately from economic damages. The emotional void a death leaves carries its own legal weight.
If the person survived for a period after the crash before dying, they may have experienced significant physical pain and distress. Illinois law allows a survival action to address what the deceased endured. This is a distinct claim separate from the family’s own grief.
A wrongful death attorney can identify which categories of compensation apply, gather medical records and financial documents, and calculate total losses. A lawyer can also handle communication with insurance companies so families are not pressured into low settlements.
