How Long Do Victims Have to File a Claim After a Pedestrian Crash in Illinois?
In Illinois, victims of pedestrian accidents have a limited amount of time to file a personal injury claim. The state’s statute of limitations for personal injury claims, including those involving pedestrian accidents, is typically two years from the date of the accident. This means that if you or a loved one has been injured in a pedestrian accident, you generally have two years to file a claim for damages.
It’s important to keep in mind that while two years may seem like a long time, it’s crucial to start the process early. Gathering evidence, obtaining medical records, and negotiating with insurance companies can take time. The sooner you begin the process, the better your chances of gathering the necessary documentation to support your claim.
If the pedestrian accident leads to a fatality, family members may also have the right to file a wrongful death claim. In Illinois, the statute of limitations for wrongful death cases is also two years, but it’s essential to consult with an attorney who specializes in wrongful death cases to understand the specific circumstances and steps involved.
If you wait too long to file your claim, you risk losing your ability to seek compensation for your injuries. It’s important to act quickly, especially when dealing with the aftermath of an accident. A pedestrian accident lawyer can assist in ensuring all deadlines are met and that you’re not left without legal recourse.
