How Wrongful Death Claims Work After a Fatal Crash in Aurora, IL
A wrongful death claim begins when the personal representative of the estate files a lawsuit against the party believed to have caused the death. The representative gathers evidence and pursues compensation for surviving family members. Police reports, medical records, and insurance records often become important parts of the process.
After a fatal wrong-way crash in Aurora, compensation may cover funeral expenses, lost future income, and loss of companionship. Medical bills connected to emergency treatment before death may also factor into the claim. Each case is different, and the total value depends on the specific losses involved.
Under Illinois law, a surviving spouse, children, and next of kin may qualify to receive compensation. If no spouse or children survive, recovery may pass to other heirs under state law. An attorney can help confirm which family members may qualify.
After a wrong-way crash, investigators may review vehicle data, road conditions, witness statements, and toxicology results to determine the cause. These findings often play a major role in establishing negligence. Some investigations may take weeks or months to complete.
Insurance companies may offer a settlement that falls short of the family’s actual losses. Accepting an early offer may limit the ability to pursue additional compensation later. You should review every offer carefully with a wrongful death lawyer before any agreement is made.
An attorney can review the facts of the crash, gather evidence, and communicate with insurance companies on your family’s behalf. Legal guidance can also help explain how Illinois wrongful death laws may apply to your case.
