How Illinois Law Handles Fatal Motorcycle Crashes in Mundelein, IL

Motorcycle crashes at busy intersections are among the most dangerous in Lake County, since riders have little protection compared to passenger vehicles.

Under the Illinois Wrongful Death Act, a personal representative of the deceased’s estate can file a claim on behalf of the surviving spouse and next of kin. This type of claim must generally be filed within two years of the date of death, and it allows the family to seek damages for loss of financial support, loss of companionship, and grief tied directly to the loss of their loved one.

It is important to note that a separate survival action can also be brought to recover damages the deceased could have claimed had they survived, such as pain endured between the crash and time of death.

Riders involved in serious crashes tend to face traumatic brain injuries, spinal damage, road rash, and broken bones, even when they wear proper safety gear. In fatal cases, families are left dealing with sudden medical bills, funeral costs, and the loss of a loved one’s income and companionship all at once.

In situations like this, a wrongful death attorney can help gather intersection camera footage, vehicle data, and witness statements before that evidence disappears. Because Illinois follows a modified comparative negligence rule, a lawyer can also help determine how fault is divided between drivers when a claim involves multiple vehicles.
