Legal Options After a Fatal Hit-and-Run in Hampshire, IL

Hit-and-run crashes remain a serious concern along the US Route 20 corridor in Illinois where traffic moves quickly between Elgin and the Illinois-Wisconsin border. Nearby corridors such as Route 72 and the I-90 tollway to the south see similarly high volumes of overnight commercial and commuter traffic, and hit-and-run crashes are not uncommon on rural stretches with limited lighting.

When a hit-and-run crash results in a death, families are commonly left to cope with sudden financial strain, including funeral costs and the loss of a loved one’s income. Emotional distress can also weigh heavily on surviving family members, especially when the driver responsible has not been identified. In fatal cases, it can take investigators weeks or months to locate a suspect, which may delay any legal steps a family wishes to pursue.

A wrongful death  lawyer can help families understand the legal process that follows a fatal hit-and-run, including how to pursue a claim through uninsured motorist coverage if the driver is never found. An attorney can assist in requesting traffic camera footage, gathering witness accounts, and working alongside investigators to help identify the vehicle involved.

In Illinois, a wrongful death claim generally must be filed within two years, and any recovery can be affected by the state’s modified comparative negligence rule, which limits or bars compensation if a party is found more than 50 percent responsible.
