The Illinois Department of Transportation inspected the overpass afterward, and identified some scrapes but no structural damage to the bridge.
Two people were taken to a local hospital with injuries. No names or ages were included in the initial reports on the crash. Three inbound lanes on the Kennedy were blocked from roughly 3:40 p.m. until 8:00 p.m., which caused delays of up to two hours.
The wreck remains under active investigation
We wish those hurt a smooth and full recovery.
How Is Fault Determined in a Truck Accident on I-90 in Chicago, IL?
When a crash involves a commercial truck in Chicago, it can become difficult to determine fault. In Illinois, liability in truck crashes can fall on the driver, the trucking company, a third-party cargo loader, or a maintenance contractor, and it solely depends on what the investigation reveals.
Trucking companies are required under federal regulations to ensure their vehicles are roadworthy and their loads are properly contained. When scrap metal or other cargo spills onto a highway, investigators will examine loading records, tie-down logs, and inspection reports to determine whether the load met federal securement standards. If it did not, liability can extend well beyond the driver behind the wheel.
Illinois follows a modified comparative fault rule, which means more than one party can share responsibility for a crash. A truck accident lawyer can help an injured person identify all liable parties, gather the relevant documentation and build a case before key evidence disappears. Key evidence that is important to preserve includes driver logs, black box data, and cargo manifests.
Commercial trucks are required to carry substantial insurance, but insurers typically move quickly to limit payouts, which is why legal representation early can make a difference in what compensation may be available for medical costs, lost wages, and other damages.
