Who Can Be Held Liable After a Fatal E-Bike Crash in Franklin Park, IL?
When an e-bike rider is killed in a collision with a passenger vehicle, liability depends heavily on which party failed to exercise reasonable care. If the vehicle driver ran a red light, failed to yield, or was distracted at the time of the crash, the driver and potentially their insurance carrier may bear responsibility.
In some cases, if a defect in the e-bike itself contributed to the accident, such as a brake failure or battery malfunction, the manufacturer could also face a product liability claim. Illinois law allows the family of a person who died due to another’s negligence to pursue a wrongful death action seeking compensation for funeral costs, lost income, and the loss of companionship.
Belmont Avenue is a well-traveled corridor in Cook County, and it carries commuter and commercial traffic through several northwest suburban communities. Morning rush hour traffic in this stretch can move quickly, and conflicts between cyclists and turning or accelerating vehicles are a recognized risk at busy suburban intersections like this one.
Families who lose someone in a fatal crash often face financial pressure on top of grief. Wrongful death claims in Illinois can seek recovery for medical bills incurred before death, burial expenses, and the emotional and financial loss suffered by surviving family members. A wrongful death attorney can also help identify whether multiple parties share liability, which can affect the total compensation a family may be eligible to pursue.
