How Long Do I Have to File a Car Accident Claim in Illinois?

In Illinois, most people have two years from the date of a car accident to file a personal injury lawsuit. This deadline is established by the Illinois statute of limitations for personal injury claims. Missing this deadline can bar a person from pursuing legal action entirely, regardless of how serious their injuries are.

The two-year clock typically starts on the date the crash occurred. However, certain situations can affect when that period begins. For example, when a minor is involved, the timeline may differ. An attorney can review the specific facts of a collision and clarify which deadlines apply to a particular case.

Acting early matters for reasons beyond the legal deadline. Evidence from a crash can disappear quickly. Surveillance footage gets deleted, witnesses become harder to reach, and physical evidence can be lost. Starting the process soon after an accident helps preserve the information that may be needed later.

Illinois also follows a modified comparative fault rule. This means that if a person is found partially at fault for a crash, their compensation may be reduced by their percentage of fault. If a court determines someone is more than 50 percent at fault, they may not be eligible to recover damages at all. Understanding how fault is assessed can help a person make informed decisions about their claim.

A Chicago car accident lawyer can gather evidence, communicate with insurance companies, and explain what types of compensation may be available. Medical expenses, lost income, and other losses may factor into a claim after a serious injury accident. Legal guidance can help clarify what options apply to a specific situation.
