Who Can File a Wrongful Death Claim in Chicago, IL?

If you lost a loved one after a Chicago crash, Illinois law usually requires the estate representative to file the claim. This person brings the case for the surviving family members who may receive any approved recovery. If no representative has been named, a court can appoint one.

The personal representative does not keep the damages recovered. They distribute any compensation to the eligible beneficiaries as directed by the court. This role is administrative, but it is essential to moving the claim forward.

If the deceased person had a spouse or children, they usually stand as primary beneficiaries in line. Illinois wrongful death claims often focus on the losses suffered by close family members. Those losses may include financial support, companionship, and other family-related harm.

When no spouse or children exist, other next of kin may have the legal right to recover compensation. Parents, siblings, or other relatives may qualify depending on the family structure. That situation can make the court process more important.

Insurance challenges can make a wrongful death claim harder to resolve after a fatal Chicago crash. The insurance company may question fault, review policy limits, or dispute the value of the family’s losses. These issues can delay the claim and make legal guidance important.

Chicago wrongful death lawyer can help you identify whether you qualify to file, who else may be involved, and what the process looks like from start to finish. An attorney can also investigate the crash, gather evidence, and communicate with insurance companies on your behalf.
