How Does the Illinois Statute of Limitations Work for a Personal Injury Claim?

In Illinois, the statute of limitations for most personal injury cases is generally two years from the date of the accident. This means a person typically has a limited window to file a legal claim, or they may lose the ability to pursue compensation. Certain exceptions can apply, depending on factors like the age of the injured person or when an injury is discovered.

This time limit plays an important role after a crash because evidence can become harder to gather as time passes. Photos, witness statements, and medical records are often easier to collect soon after the incident. Acting within the allowed timeframe helps preserve important details that may support a claim.

Injuries from accidents can range from minor to severe, and some may take time to fully develop. People may notice soreness or stiffness hours or even days later. Medical evaluations not only support recovery but also create documentation that may be useful if a claim is filed within the legal deadline.

After being injured in an accident, a personal injury lawyer can help explain how the statute of limitations applies to a specific situation. An attorney can review timelines, organize records, and clarify what legal options may still be available.
