The recalled product contains lidocaine, which can cause serious injury or death if swallowed. According to the recall notice, the ointment is sold in packaging that is not child-resistant, making it easy for children to access the contents. This packaging does not comply with requirements under the Poison Prevention Packaging Act.

At the time of the announcement, no adverse events or injuries had been reported.

What Lidocaine Ointment Was Recalled?

The lidocaine cream recall involves Mamisan Pain Relieving Topical Ointment jars, sold in the following packaging:

  • Container: Orange 3.52-ounce jar
  • Lid: White, single-thread lid with the Mamisan trademark printed on top
  • UPC Code: 860006498115

What Should I Do About the Recall?

The CPSC advises consumers to keep the recalled lidocaine ointment out of the sight and reach of young children while awaiting a replacement lid. Consumers should contact Plantimex Distributors, Inc. to obtain the free child-resistant replacement lid.

Once the replacement lid has been properly applied, the product may continue to be used as directed.

Why Is Ingesting Lidocaine Ointment Dangerous?

Lidocaine is meant primarily for topical usage, or injection as a local anesthetic. There is a specific prescription formula can be swallowed in measured doses to treat mouth and throat pain under the supervision of a doctor. However, ingestion of any lidocaine products can be harmful.

The recalled lidocaine ointment is not formulated for ingestion. When ingested, it can lead to high concentration in the blood, which has a major effect on the body’s organs, leading to problems such as life-threatening effects on the central nervous system and cardiovascular system, including seizures, heart problems, and death.

  • Central Nervous System: Symptoms such as light-headedness, dizziness, confusion, tinnitus (ringing ears), or blurred vision may appear. These symptoms can progress to more serious ones such as muscle twitching, slowed breathing, seizures, coma, and respiratory arrest.
  • Cardiovascular System: High levels of lidocaine can affect the heart’s electrical system, leading to slowed heart rate, low blood pressure, irregular heartbeats, and in more severe cases, cardiac arrest (heart attack).
  • Methemoglobinemia: In rare cases, lidocaine ingestion can lead to a blood disorder where the red blood cells are unable to carry enough oxygen to the body’s tissues, leading to pale, blue, or gray skin and lips, shortness of breath, and fatigue.

Young children are at a higher risk of serious injury or death from lidocaine ingestion. As such, the FDA has issued warnings stating that even oral lidocaine should never be given to young children or infants to treat teething issues, as there is a risk of the child ingesting too much of the product.

If your child has ingested lidocaine, contact poison control or call 911 and get medical advice or treatment immediately.

What Damages Can I Recover in a Lidocaine Poisoning Claim?

If a child or loved one is harmed after ingesting lidocaine ointment, you may be entitled to pursue financial compensation through a product liability or negligence claim. The specific damages available depend on the severity of the injury, the long-term effects, and the circumstances surrounding the poisoning.

Commonly recoverable damages in a lidocaine poisoning claim may include:

  • Medical expenses, including emergency care, hospitalization, toxicology treatment, medications, follow-up visits, and any future medical care related to the injury.
  • Lost income or loss of earning capacity, if a parent or caregiver was forced to miss work to care for an injured child, or if the injured person is unable to return to work.
  • Pain and suffering, which accounts for physical pain, emotional distress, trauma, and reduced quality of life caused by the poisoning.
  • Loss of enjoyment of life, when the injury interferes with normal daily activities or causes lasting physical or cognitive limitations.

In cases involving fatal poisoning, surviving family members may also pursue wrongful death damages, which can include funeral and burial costs, loss of financial support, and loss of companionship.

In limited circumstances, punitive damages may be awarded if the manufacturer or distributor acted with reckless disregard for consumer safety, such as failing to comply with federal packaging regulations. While punitive damages are not available in every case, they are intended to punish egregious conduct and deter future harm.
