What Damages Are Available in a Fatal Motorcycle Accident Case in Illinois?

In Illinois, surviving family members may be eligible to seek compensation through a wrongful death claim following a fatal motorcycle accident. Recoverable damages can include medical expenses incurred before death, funeral and burial costs, and the loss of financial support the deceased provided to their family.

Beyond economic losses, Illinois law also allows families to seek compensation for non-economic damages. These can include the loss of companionship, guidance, and the emotional support the deceased provided to a spouse or children. These claims exist to help families manage the financial impact of a sudden and tragic death.

Illinois wrongful death claims must generally be filed within two years of the date of death. The claim is typically brought by the surviving spouse, children, or other dependents of the deceased. A wrongful death attorney can help identify who qualifies to file and what documentation may be needed to support the case. Evidence such as income records, medical bills, and proof of the family relationship often plays an important role in these cases.

Determining liability in a fatal motorcycle and truck crash can be complex. Factors such as driver error, unsafe lane changes, speeding, or mechanical failure may all be relevant. An attorney can review available evidence, communicate with insurance companies, and explain what legal options may apply to your situation.
