On November 3, 2017, Howard Ankin presented at the Illinois Trial Lawyers Association workers’ compensation seminar.
The Illinois Trial Lawyers is an association of lawyers who advocate on behalf of injured people. ITLA provides education to both lawyers and elected officials on legislation and case law which affects the rights of injured people. The Association maintains a board of managing attorneys whose board is elected by membership. Howard Ankin is a board member and co-president of the worker’s compensation section of the Association.
Every November the Association holds a yearly workers compensation seminar. Lecturing at this seminar is by invitation and on topics at the forefront of the law.
Howard Ankin presented on the problems with payment of medical bills and interest owed on outstanding medical bills. In August the State based case of Marque Medicos Fullerton vs. Zurich Insurance Company was followed by a federal case filed in September of Michael B. Beatty vs. Accident Fund Insurance making issue of non-payment of interest on outstanding medical bills to medical providers.
Ankin lectured that these recent filings were a warning shot to workers compensation lawyers that 2005 and 2011 law changes to the Illinois Worker’s Compensation Act left many unresolved issues pertaining to payment of bills and interest. He remarked that employers were attempting to take advantage of injured workers based on these unresolved issues.
Ankin advised the audience how to best negotiate settlement contracts, write proposed trial decisions, and made suggestions for how the law should be modified in the future.
