Bayer Healthcare Reaches Settlement in Yaz/Yasmin Lawsuits

Earlier this month, Bayer Healthcare announced that it has settled 70 lawsuits involving allegations related to side effects caused by nuvaring birth control pills.  Yasmin and Yaz are birth control pills taken daily to artificially regulate a woman’s menstrual cycle through the use of hormones that have been known to cause blood clots, stroke, heart attack, gall bladder disease, and pancreatitis.

Thousands of lawsuits have been filed against Bayer, in which plaintiffs allege that serious medical problems were caused as a result of the drospirenone that is contained in Yaz and Yasmin.   Last year, the FDA reported that women who have taken Yaz experienced a 75% chance of developing a blood clot and that use of drospirenone birth control pills doubles the risk of thrombo-embolism and strokes in new birth control pill users.

Due to the sheer volume of lawsuits filed against the manufacturer of Yaz and Yazsmin, the lawsuits have been consolidated into a multidistrict (MDL) in the U.S. District Court for the Southern District of Illinois.  The purpose of the MDL is to resolve common factual issues and to streamline the discovery process.

The FDA announced that new information has become available regarding the possible medical dangers associated with Yaz and Yasmin and that it will continue to evaluate the risk of blood clots to women who use birth control pills that contain drospirenone.

Earlier this year, Bayer was ordered to participate in settlement negotiations before the first cases, known as bellwethers, would be submitted to a jury.  The first bellwether trials had originally been scheduled for April 2012, but were postponed until June 2012 in light of the settlement negotiations.

Bayer continues to face about 11,300 additional claims in federal court, in which plaintiffs allege that they suffered serious and fatal injuries as a result of the use of Yaz or Yasmin.  Bayer’s settlement with respect to the bellwether cases could increase the likelihood of its settlement of the other pending claims, as well.
